TERMS AND CONDITIONS AND OTHER IMPORTANT NOTICES

PASSENGERS ON FLIGHTS WITH A FINAL DESTINATION OR STOP IN A COUNTRY OTHER THAN THE COUNTRY OF DEPARTURE ARE INFORMED THAT INTERNATIONAL AGREEMENTS KNOWN AS THE MONTREAL CONVENTION, OR ITS PREDECESSORS, THE WARSAW CONVENTION, INCLUDING THEIR AMENDMENTS (THE WARSAW CONVENTION SYSTEM), MAY APPLY TO THE ENTIRE FLIGHT, INCLUDING PARTS OF IT WITHIN ONE COUNTRY. FOR THESE PASSENGERS, THE APPLICABLE AGREEMENT, INCLUDING SPECIAL TRANSPORTATION AGREEMENTS INCLUDED IN ANY APPLICABLE TARIFF, GOVERNS AND MAY LIMIT THE LIABILITY OF THE CARRIER.

NOTICE OF LIABILITY LIMITATION

The Montreal Convention or the Warsaw Convention system may apply to your flight, and these conventions govern and may limit the liability of air carriers for bodily injury or death, loss or damage to baggage, and delays.

When the Montreal Convention applies, liability is limited as follows:

  1. There are no financial limits for bodily injury or death.
  2. Regarding destruction, loss, damage, or delay of baggage, liability is limited to 1,131 Special Drawing Rights (approximately 1,200 EUR; 1,800 USD) per passenger in most cases.
  3. For damages caused by flight delays, liability is limited to 4,694 Special Drawing Rights (approximately 5,000 EUR; 7,500 USD) per passenger in most situations.

Regulation (EC) No. 889/2002 requires Community air carriers to apply the provisions of the Montreal Convention and related liability limits to all passenger and baggage air transportation activities. Many non-Community carriers have also chosen to apply the same convention to the transportation of passengers and their baggage.

When the Warsaw Convention system applies, the following liability limits may apply:

  1. 16,600 Special Drawing Rights (approximately 20,000 EUR; 20,000 USD) for bodily injury or death if the Hague Protocol applies, or 8,300 Special Drawing Rights (approximately 10,000 EUR; 10,000 USD) if only the Warsaw Convention applies. Many carriers have voluntarily waived these limits entirely, and U.S. regulations provide that for flights to, from, or with an intermediate stop in the United States, the limit must not be less than 75,000 USD.
  2. 17 Special Drawing Rights (approximately 20 EUR; 20 USD) per kilogram for loss, damage, or delay of checked baggage and 332 Special Drawing Rights (approximately 400 EUR; 400 USD) for unchecked baggage.
  3. The carrier may be liable for damages caused by delay.

You can obtain more information from the carrier regarding the applicable liability limits for your flight. If your flight involves multiple carriers, you should contact each carrier individually for information on the applicable liability limits.

Regardless of the applicable convention for the flight, you can benefit from a higher liability limit in case of loss, damage, or delay of baggage by declaring a special value for the baggage at check-in and paying any applicable additional fees. Otherwise, if the value of your baggage exceeds the applicable liability limit, you should fully insure your baggage before travel.

Time Limit for Legal Actions: Any action for compensation must be started within two years from the date of arrival of the aircraft or the date the aircraft should have arrived. Claims regarding baggage: Written notice must be sent to the carrier within 7 days of receiving checked baggage in case of damage and within 21 days from the date it was provided to the passenger in case of delay.

Notice of Contractual Terms Incorporated by Reference

  1. Your contract for air transport with the carrier providing your air transport, whether international, domestic, or part of an international journey, is subject to this notice; any notices or receipts from the carrier; and the individual terms and conditions of the carrier (Terms), rules, regulations, and policies (Rules) and any applicable tariffs.
  2. If your transport is performed by multiple carriers, different terms, Rules, and any applicable tariffs may apply to each carrier.
  3. The Terms, Rules, and any applicable tariffs of each carrier are, by this notice, incorporated by reference and form part of your contract for air transport.
  4. Any inconsistency between this notice and the actual contract of carriage or any other document will be resolved in favor of the actual contract or document.

Your contract for air transport with the carrier providing your air transport, whether international, domestic, or part of an international journey, is subject to this notice; any notices or receipts from the carrier; and the individual terms and conditions of the carrier (Terms), rules, regulations, and policies (Rules) and any applicable tariffs.

  1. If your transport is performed by multiple carriers, different terms, Rules, and any applicable tariffs may apply to each carrier.
  2. The Terms, Rules, and any applicable tariffs of each carrier are, by this notice, incorporated by reference and form part of your contract for air transport.
  3. The Terms may include, but are not limited to:
    - The carrier's conditions and limits of liability for passenger injury or death.
    - The carrier's conditions and limits of liability for loss, damage, or delay of goods and baggage, including fragile or perishable items.
    - Special rules for declaring a higher value for baggage and paying any applicable additional fees.
    - Application of the carrier's conditions and limits of liability regarding actions taken by agents, employees, and representatives of the carrier, including anyone providing equipment or services to the carrier.
    - Restrictions on claims, including time limits for passengers to file claims or start proceedings against the carrier.
    - Rules regarding reconfirmations or reservations; check-in times; use, duration, and validity of air transport services; and the carrier's right to refuse transport.
    - The carrier's rights and limits of liability for delays or inability to perform services, including schedule changes, alternate carriers or aircraft, and rerouting, and, if required by applicable law, the carrier's obligation to notify passengers of the identity of any substituted carrier or aircraft.
    - The carrier's right to refuse transport to passengers who do not comply with applicable laws or do not present all necessary travel documents.
  4. You can obtain more information about your transport contract and how to get a copy of it at ticket sales points. Many carriers have included this information on their websites as well. If required by applicable law, you have the right to review the full text of your transport contract at the airport and at the carrier's sales points and, upon request, have the right to receive a free copy by mail or other delivery services from any carrier.
  5. If a carrier sells air transport services or accepts baggage for transportation from another carrier, it does so only as an agent for the other carrier.

SOME COUNTRIES MAY REQUIRE YOUR CARRIER TO PROVIDE INFORMATION ABOUT OR ALLOW ACCESS TO PASSENGER DATA.

DENIED BOARDING: Flights may be overbooked, and there is a small chance that there may not be available seats on the flight, even if you have a confirmed reservation. In most cases, if you are involuntarily denied boarding, you are entitled to compensation. If required by applicable law, the carrier must seek your consent before involuntarily denying boarding to anyone. Contact the carrier for the complete rules on Denied Boarding Compensation (DBC) and information on the carrier's boarding priorities.

BAGGAGE: For certain types of items, a higher value may be declared. Carriers may apply special rules for fragile, valuable, or perishable items. Check with your carrier. Checked Baggage: Carriers may provide a free checked baggage allowance, determined by the carrier and may depend on the class and/or route. Carriers may apply additional fees for checked baggage exceeding their provided allowances. Consult your carrier. Hand Baggage: Carriers may provide a free hand baggage allowance, determined by the carrier and may depend on the class, route, and/or type of aircraft. It is recommended to minimize hand baggage. Consult your carrier. If multiple carriers provide your travel, each carrier may have different baggage rules (both checked and hand baggage). SPECIAL BAGGAGE LIABILITY LIMITS FOR TRAVEL TO THE UNITED STATES: For wholly domestic flights between locations within the United States, federal law imposes a liability limit on each carrier for baggage to be at least 3,300.00 USD per passenger or the amount mandated by 14 CFR 254.5.

CHECK-IN TIMES: The time shown on the ticket/receipt is the flight departure time. The flight departure time is not the same as the check-in or boarding time. Your carrier may refuse transport if you are late. The check-in times announced by the carrier are the latest times passengers can be accepted for the flight; the boarding times announced by your carrier are the latest times passengers must be present for boarding.

DANGEROUS GOODS (HAZARDOUS MATERIALS). For safety reasons, dangerous goods must not be packed in checked or hand baggage unless expressly permitted. Dangerous goods include but are not limited to: compressed gases, corrosives, explosives, flammable liquids and solids, radioactive materials, oxidizing materials, poisons, infectious substances, and bags with installed alarm devices. For safety reasons, additional restrictions may apply. Check with your carrier.
