General Terms and Conditions

The commercial company "EMA PLUS SOLUTIONS" EOOD, registered in the Commercial Register with registration number J40/19757/2017, unique registration code 38540407, headquartered in Bucharest, Bucharest-Ploiesti Street, 73-81, 4th floor, building number 4, office 20, establishes the general terms, concepts, and conditions for using and purchasing available travel services.

These conditions, which may change from time to time, apply directly or indirectly (through distributors) to all our services available online, via email, and by phone. By using, searching, and utilizing our website/software and/or making a reservation, you acknowledge and agree that you have read, understood, and agreed to all the terms and conditions below, without limitation. If you disagree with any of the points mentioned, you may refrain from using the offered services.

These pages, their content, and infrastructure, as well as the online booking service provided on these pages and through this website ("the service"), are owned, operated, and provided by www.fly24.bg ("Fly24.bg", "we", "us", or "our"), and are provided solely for your personal, non-commercial use, under the terms and conditions specified below.

Conditions for Airline Tickets

When booking, the payment terms provided by the airlines will be presented to you. For regular airline reservations, most require the ticket to be paid for within 24 to 48 hours, during which time Fly24.bg guarantees the availability of seats and prices. This information can be found on the page and in the booking confirmation email. If payment is not made within the specified period, the airline reserves the right to automatically cancel the tickets.

For low-cost tickets and Smart Connections tickets, reservations cannot be made without the payment being registered in Fly24.bg's accounts. Therefore, Fly24.bg does not guarantee the availability of seats and prices as communicated during the booking process. They will only be guaranteed after payment is made and the airline tickets are issued.

Attention: Between the moment of submitting reservation requests on the website or by phone and the moment the airline tickets are paid for and the payment is visible in Fly24.bg's account by its employees, there may be changes in price or unavailability of seats. In such situations, Fly24.bg will notify the passengers and communicate the next price or offer new flight options that meet their needs.

Service Fee

The service fee is the amount you must pay to the travel service provider, in this case, Fly24.bg, for services not typically provided directly by the airlines, such as:

Information and passenger support in case of changes or modifications that may occur during the booking process or the flight itself.

Individual advice and assistance to each customer regarding preferred payment methods.

Mediation in communication between passengers, the airline, and the airport.

Covers the costs of issuing the airline ticket.

Assistance in situations like flight changes, refunding expenses for unused airline tickets.

The service fees applied by Fly24.bg are not included in the price of airline tickets and may vary from one offer to another. Fly24.bg reserves the right to determine the applicable service fees. For additional services (including but not limited to baggage, preferred seats, sports equipment, pets, special assistance, and others), purchased at the time of issuing airline tickets or after their issuance, Fly24.bg reserves the right to apply a service fee.

In case of cancellation of airline tickets/travel services (initiated by the user or the travel service provider/airline/hotel, etc.), the service fee charged by Fly24.bg at the time of issuing the ticket or selling any travel services is non-refundable.

Cancellation/Modifications

If you wish to cancel or modify the reserved or purchased service (and if the service provider allows it), you are responsible for notifying Fly24.bg in writing or by phone of your intentions. In certain cases, you may not be able to cancel/modify airline tickets or may need to comply with specific requirements for these actions. Fly24.bg and the service provider accept all forms of written requests. Fly24.bg and the service provider cannot cancel/modify the airline ticket before receiving your official request.

When modifying the reservation (including but not limited to cancellations, refunds, name changes), Fly24.bg reserves the right to apply certain fees to cover the administrative costs that may arise from this action. These fees differ from the fees charged directly by the airline.

In case of voluntary or involuntary cancellation of airline tickets, the service fee set at the time of issuing the ticket is non-refundable.

In case of force majeure and extraordinary circumstances, the airline may cancel or delay the flight and cancel the reservation without prior notice to the passenger, and the money will be refunded to the passenger or new flight options will be offered. In all these cases, the passenger will be informed directly by the airline or by Fly24.bg representatives.

The fare rules applied by the airlines in case of changes or cancellation of paid airline tickets are displayed during the booking process. After payment, changes or cancellations of airline tickets are strictly carried out according to these fare rules.

Baggage

Each airline has its own baggage transportation rules. This information is presented on the website during the booking process or by Fly24.bg consultants by phone.

For some airlines, hand and/or checked baggage is included in the price communicated on the website. For low-cost airlines and some regular airlines, baggage is charged separately from ticket prices, and this information will be provided during the booking process. Baggage can be purchased during the booking process or after the airline tickets are issued, but no later than during the check-in process.

Each airline has different limitations (weight or length/width/height) for hand or checked baggage. If you exceed these dimensions, the airline has the right to charge you an additional fee.

Check-in

Check-in at the airport can be done for both regular and low-cost airlines, but low-cost airlines charge an additional fee during the check-in process. To avoid paying an additional fee, Fly24.bg recommends checking in online before the flight. Information about online check-in will be communicated by Fly24.bg agents during the booking process. Upon request, a Fly24.bg agent will perform the check-in and upload it to your reservation, from where you can later download the boarding pass. Printing the boarding passes is mandatory for some airlines, and you will be informed by our agents. Fly24.bg offers this service for free and is not obligated to do so. The passenger is responsible for performing, printing, and presenting the boarding passes at check-in.

Smart Connections

The Fly24.bg flight booking website offers its users the Smart Connections application (hereinafter referred to as "Smart Connections"), which represents an advanced algorithm for searching flight combinations.

The combinations found using the Smart Connections application include two or more flights on one or more airlines, but each flight is offered as a separate service, and the airlines do not collaborate in creating such flight options. The set of flights found by the unique Smart Connections algorithm will be hereinafter referred to as "Flight Option". Purchasing tickets for a specific Flight Option using Smart Connections does not constitute the purchase of a single airline ticket for the entire route with one or more direct connections. When you decide to purchase airline tickets found using Smart Connections, the user will formally make a RESERVATION for each individual ticket, for one or more airlines.

Since the user purchases separate tickets for each flight from the Flight Option and because the configurations of flight connections may provide short connection times (considering the search criteria indicated by the user and the availability of flights), there is a risk of flight cancellation, delay, or time change, which may result in the inability to use the subsequent flight or flights from the Flight Option.

When the search results using the Smart Connections function provide information that the Flight Option is covered by Fly24.bg Guarantee, it means that when purchasing tickets as part of this Flight Option, the user will receive assistance from Fly24.bg, according to the conditions described in the Fly24.bg Guarantee - click here - https://www.fly24.bg/bg/guarantee

Force Majeure

"Force majeure" refers to unforeseen events caused by natural phenomena, such as earthquakes, landslides, fires, droughts, strong winds, heavy rains, floods, hailstorms, snowfalls, etc., or by economic or social circumstances, such as revolutions, military actions, blockades, strikes, bankruptcies, import or export bans at the state level, epidemics, etc. The list of such phenomena and circumstances is not exhaustive. An event can be recognized as force majeure only if its existence objectively leads to the impossibility of fulfilling contractual obligations or to their non-conforming performance.

Non-fulfillment of an obligation does not apply to the debtor in case of force majeure if the event or the consequences of force majeure could not be known to the debtor at the time the obligation arose, or if the debtor could not prevent or eliminate the event of force majeure or its consequences.

1. SERVICES

1.1 Through the website www.fly24.bg and/or specialized software, the company "EMA PLUS SOLUTIONS" EOOD and associated partners provide a dynamic online database for booking and purchasing airline tickets, through which, at the customer's request, using a special search form on the website, all available flight options and their prices at the time of the request can be displayed. By filling out the reservation form provided by the website www.fly24.bg and/or specialized software, the customer books a flight option.

1.2 The information provided on our website regarding possible flight options and their prices represents the information of the airlines operating the requested routes.

1.3 Through this website, we (www.fly24.bg and associated (distributor) partners) provide an online platform through which all types of temporary accommodations (e.g., hotels, motels, hostels, and guesthouses, collectively referred to as "accommodations") can advertise their rooms for reservation, and through which website visitors can make these reservations. By booking a room through Fly24.bg, you enter into a legally binding contract directly with the accommodation where you make the reservation. From the moment of making the reservation, Fly24.bg acts solely as an intermediary between you and the accommodation, transmitting the relevant reservation details to the user and sending a confirmation email to the user on behalf of the accommodation.

1.4 Each provider is always responsible for the accuracy, completeness, and correctness of the information (including prices and availability) presented on our website. Our website does not constitute and should not be considered a recommendation or endorsement of the quality, service level, or classification of any available accommodation.

1.5 Fly24.bg's services are exclusively for personal and non-commercial use. Therefore, you are prohibited from reselling, using, copying, monitoring, displaying, saving, or reproducing any content or information, software, products, or services available on Fly24.bg's website for any commercial or competitive activity or purpose.

1.6 Our website should not be interpreted as a recommendation or guarantee in favor of any proposed flight option (regarding quality, service level, or ranking).

1.7 For each specific request, at any time, the dynamic database generates a version of the current travel services at the time of the request, which corresponds to the actual availability of services according to the criteria requested by the user/customer.

1.8 Each reservation made on Fly24.bg is considered an intention by the user to purchase a specific travel product or service from the travel service provider. If the user's request is accepted, Fly24.bg will send a confirmation email.

1.9 All travel services published on the website and/or through Fly24.bg's software are subject to the availability of travel service providers. The general terms and conditions of the travel service provider (including passenger rules imposed by airlines) apply in addition to the General Terms and Conditions specified by Fly24.bg.

1.10 The general terms and conditions of the travel service providers may include provisions regarding various payment procedures, obligations, cancellation of reservations, changes and refunds (if applicable), or other restrictions. Some airlines may impose additional fees. Fly24.bg is not responsible for costs that may arise during transfers between airports or terminals.

1.11 Fly24.bg is not responsible for collecting various additional local fees from some hotels.

1.12 The customer/passenger is directly responsible for complying with the conditions imposed by the travel service provider regarding boarding time, flight confirmation, or any other rules.

2. CONDITIONS. AIRLINE TICKETS.

2.1 Flight seat reservations are made using international computer reservation systems that allow Fly24.bg to access the company's database and make actual reservations for specific flights in favor of potential passengers.

2.2 Reservations are free of charge and are made before the departure date. The duration of the reservation of a flight option varies depending on the limitation set by the airline or airlines operating the flights in the reserved flight option. The duration of the reservation can be changed at any time by the airline or airlines operating the flights in the reserved flight option without prior notice to "EMA PLUS SOLUTIONS" EOOD. Therefore, "EMA PLUS SOLUTIONS" EOOD displays this duration approximately and cannot guarantee its accuracy in any way.

2.3 When making the reservation, the passenger will receive information from Fly24.bg about the price of the flight (valid at the time of the reservation), as well as information about the conditions and rules applicable to the airline ticket that can be purchased based on the reservation.

2.4 All conditions, rules, and restrictions applicable to the airline ticket are determined by the airline and other factors (e.g., visa requirements) independent of Fly24.bg's will. These rules, as well as the price of the airline ticket, can be changed at the discretion of the entities imposing them until the ticket is purchased, without Fly24.bg being responsible in any way. The price of the airline ticket for certain flight options may change during the issuance process. If there is a possibility of a price increase after the customer has paid for the flight option, the customer will be notified of this before the ticket is issued. If the flight options become more expensive after payment, during the issuance process, the passenger will be given the opportunity to pay the price difference to complete the issuance of the flight options, or the entire amount paid will be refunded to the passenger using the same payment method used for the initial payment. Fly24.bg is not responsible for price increases of airline tickets during the issuance process, even after the customer has made the payment.

2.5 Presenting the flight options on the website www.fly24.bg constitutes an offer from Fly24.bg, and the customer's payment for a specific offer constitutes the passenger's confirmation of agreement to enter into a contract for the sale of airline tickets with Fly24.bg and a contract for the carriage of passengers and baggage with the airline. From the moment the passenger receives the airline ticket according to the selected and paid offer, the contract for the sale of airline tickets between the passenger and Fly24.bg, as well as the contract for the carriage between the airline and the passenger, are considered concluded. The route sent to the email address provided by the customer during the flight selection and payment represents the travel document confirming the conclusion of the contract for the sale of airline tickets and the contract for carriage.

2.6 By paying for the ticket, the customer acknowledges that they understand that they are entering into a transportation contract and establishing direct legal relations with the carrier. Furthermore, by paying for the ticket, the customer agrees that in case of any claims related to transportation services, they will contact the carrier directly, including in case of the carrier's bankruptcy. Fly24.bg is not a guarantor or representative of the carrier.

2.7 When booking a flight, the user has the opportunity to enter the loyalty card data if they are already registered in such a program with the airline. These loyalty programs are subject to the conditions imposed by the respective company.

2.8 The prices of airline tickets sold through Fly24.bg result from a complex system of fare rules, contractual fares, fares published in centralized reservation systems, special fares, Fly24.bg service fees, and others. Under these conditions, each flight requires calculating the applicable price for that specific airline ticket. The same flight with the same airline may generate different prices.

2.9 Some fares or special offers may not allow cancellation or changes. The user is obliged to check the fare rules for the reserved airline ticket.

2.10 Paying for the airline ticket means that the user/passenger is familiar with all fare conditions and agrees with them.

2.11 The airline ticket is the document, written instrument, or electronic document based on which the flight is carried out. The airline ticket is issued by Fly24.bg but is owned by the airline for which it is issued.

2.12 The passenger who purchased the airline ticket is obliged to keep it in good condition and present it for boarding to be admitted on the flight. Loss or damage to the airline ticket by the passenger does not entitle them to receive a new ticket, and the passenger bears full responsibility for the inability to fly due to this reason, without being able to claim compensation from Fly24.bg or the airline.

2.13 The terms of the contract and the information specified on the airline ticket supplement these general terms and conditions. It is considered that the passenger who received the airline ticket is familiar with this information.

2.14 The customer/passenger must adhere to the recommended check-in time (before departure) set by the airlines. Usually, this is 120 minutes for international flights and 90 minutes for domestic flights.

2.15 Some airlines require flight confirmation at least 72 hours before departure. Failure to comply with this rule may result in the cancellation of the flight reservation. The flight coupon of the airline ticket must be used sequentially. If this condition cannot be met, the airline reserves the right to cancel the corresponding ticket.

2.16 Fly24.bg is not responsible and cannot be claimed for compensation if the passenger does not fly under the following conditions: - the passenger did not show up on time for boarding (120 minutes before the scheduled departure time specified on the ticket) - the passenger is denied boarding due to issues related to their travel documents (including lack of a visa for the destination country, fake visa, passport with travel restrictions, and others) or in case of unjustified refusal by the authorities to allow travel. - other circumstances or force majeure events that Fly24.bg could not foresee or prevent.

2.17 Fly24.bg is not responsible for cancellations, delays, or schedule changes made by the airline for which the ticket is issued, for the quality of the flight, or for services related to the flight (e.g., lost baggage), which fall directly under the airline's responsibility. Fly24.bg, in accordance with the Warsaw Convention, is subject to the airline's claims in such situations. In such cases, the passenger must contact the carrier directly, who will compensate the passenger according to international rules.

2.18 The passenger may cancel the purchased airline ticket at any time before the departure date. Regardless of the reason for cancellation, the airline's cancellation policy will apply. Usually, a fine of 100% of the ticket value, including fees and TSF (Ticket Service Fee) + 10 EUR TSF for cancellation, is applied. If the airline's rules allow for more favorable cancellation conditions, Fly24.bg will apply these rules in favor of the passenger, without affecting the retention of the TSF and TSF for cancellation.

2.19 The passenger may change the initially purchased ticket according to the conditions set by the respective airline, individually for each case, by paying an additional fee set by the airline. Usually, a fine of 100% of the ticket value, including fees and TSF + 10 EUR TSF for cancellation, is applied. If the airline's rules allow for more favorable conditions, Fly24.bg will apply these rules in favor of the passenger, without affecting the retention of the TSF and TSF for cancellation.

2.20 The passenger cannot use only certain segments of the purchased flight. Failure to show up for the first flight is considered a ticket waiver, and the provisions of these general terms and conditions will apply.

2.21 The passenger cannot transfer the airline ticket to a third party.

2.22 Failure to show up for a flight usually results in the loss of the airline ticket, with a fine of 100% of the ticket value.

2.23 The passenger is responsible for complying with all necessary travel formalities (police, customs, health, passport, visa, etc.), and Fly24.bg has no responsibility in this regard. Refusal of boarding for any of these reasons is the exclusive responsibility of the passenger, who cannot claim compensation from Fly24.bg or the airline.

2.24 Due to the situation created by mass asylum requests or illegal stays in Western countries, authorities in all countries, even with a valid visa issued by the embassies of the respective countries, may refuse border crossing or boarding the plane. In such situations, Fly24.bg is not responsible for the inability to transport, as it results from third-party actions.

3. CONDITIONS. HOTEL RESERVATIONS

3.1 Through the software or the website www.fly24.bg and other websites owned by entities collaborating with Fly24.bg, hotel services are offered to the customer/user, detailed in individual offers.

3.2 The customer/user can submit a hotel reservation request through the Reservation System available on the website www.fly24.bg, by entering all necessary data in the form and/or other websites owned by entities collaborating with Fly24.bg.

3.3 Confirmation of the request and the rate. Fly24.bg sends confirmation of the request to the email address provided by the customer/user. The confirmation includes the reservation number and details about the hotel services, the total value of the services (valid at the time of the reservation), and the chosen payment method. The customer/user is obliged to check the accuracy of the entered data before making the payment.

3.4 The customer/user must comply with the specified check-in and check-out times for each hotel. Usually, the standard check-in time is 14:00, and the check-out time is until 11:00.

3.5 Fly24.bg is not responsible to the customer/user for any improper provision of services ordered and paid for on-site in the country of residence or destination.

3.6 The information contained on www.fly24.bg and other advertising materials of Fly24.bg is presented at the time of their preparation and may differ from the actual data, as they are subject to changes. All information about the ordered travel services corresponds to the situation at the time of submitting the Request and may not correspond to the actual data, as they are subject to changes.

3.7 Fly24.bg exclusively uses the hotel classification provided by the tourist service providers in the country of residence, providing information about the categories of hotels (number of stars). Hotel classification is carried out by each such partner company based on its business practice standards and may not match the category (number of stars) determined by official authorities or hotel management. Due to significant differences in regulatory practices for standardizing and certifying hotel services abroad, official documents certifying the services may only be issued to tourists if they are available from partner companies. 3.8 By making the payment for the hotel reservation, the customer confirms that they understand they are entering into an accommodation contract and establishing direct legal relations with the accommodation provider. Furthermore, by making the payment for the reservation, the customer accepts that in case of any claims related to accommodation services, they will address them directly to the accommodation provider. Fly24.bg is not a guarantor or representative of the accommodation provider or other travel service providers. 3.9 By making a reservation with an accommodation provider, the customer/user agrees to comply with the cancellation policy and the no-show policy of that accommodation provider and any other general terms and conditions (delivery) of the accommodation provider that may apply to the reservation or stay of the customer/user, including for services or products offered by the accommodation provider (the terms and conditions of the accommodation provider can be obtained from the respective accommodation provider).

4. RATES AND PRICES

4.1 In response to the completed request by the customer/user in the search form on the fly24.bg website or through the respective software, all requested and available travel service options, along with the prices valid at the time of the request, are displayed.

4.2 Some rates or special offers may not allow cancellation or changes. The customer/user must check the specific rules for the rate of the reserved travel services.

4.3 For direct credit card payment on the site, fly24.bg will collect the ticket amount as follows: - in euros, regardless of the cardholder's base currency. Additionally, to reduce the impact of credit card fraud attempts, before issuing travel documents, fly24.bg reserves the right to conduct random checks, requesting proof of the user's address, a photo of the card used for payment, a photo of the cardholder's identification document, and a recent bank statement. All rates and fees may change due to exchange rate fluctuations.

4.4 The prices of services sold through fly24.bg result from a complex system of fare rules, contractual prices, prices published in centralized reservation systems, special prices, fly24.bg service fees, and others. Under these circumstances, each specific travel product requires calculating the applicable price for that service. The same service, from the same airline, may generate different prices. Due to the numerous prices applicable to travel services, these prices and their applicable rules cannot be displayed or published.

4.5 The price of each service implies specific conditions, rules, and restrictions that apply to that service. The customer/user/passenger is obliged to familiarize themselves with these rules before purchasing the respective product. After purchasing the service, it is considered that the customer/user/passenger is familiar with all these rules and cannot claim ignorance or lack of information.

4.6 If the customer/user/passenger pays for the airline ticket in cash at the office of the partner agency, the payment is made in RON or EUR at the exchange rate of the National Bank of Romania +2%, relative to USD or another currency to which the airfares are linked. 4.7 Other payment methods, except those presented on the website, are not accepted, and we are not responsible for amounts sent by courier. 4.8 For its specific activity, fly24.bg applies a service fee policy, abbreviated as TSF (Ticket Service Fee or Transaction Service Fee). These fees are non-refundable in case of cancellation or change of the ticket by the customer. 4.9 Fly24.bg or the service provider reserves the right to collect additional fees (or commissions) that may arise during credit card reservations. In this case, you will be informed of the applicable commissions.

5. OTHER CONDITIONS

5.1 This regulation, as well as the provision of our services, is governed by the applicable laws of Romania, the Rules of the International Air Transport Association (IATA), and the Warsaw Convention.

5.2 The display of these general conditions by fly24.bg implies the customer's/user's obligation to read them. It is considered that the user/customer/passenger who purchased a travel service from fly24.bg is familiar with the content of these conditions and cannot later claim ignorance or lack of information.

5.3 Unless otherwise specified, the information, computer programs, software necessary for providing fly24.bg's services and used on the www.fly24.bg website, as well as the copyright and economic rights to them as intellectual property, belong to fly24.bg or its suppliers.

5.4 All disputes arising in connection with this regulation, the airline ticket sales contract, the carriage contract, and the provision of our services will be resolved through negotiations or in the courts of Romania, unless the Agency specifies otherwise.

5.5 Under the limitations specified in this regulation, for the provision of services, fly24.bg is responsible only for direct damages caused by the actual non-performance of our obligations in providing the services and only within the commission fee collected from the respective service provider.

5.6 If a clause or part of these Conditions is declared invalid, the remaining valid clauses will continue to be in force.

5.7 In case of complaints regarding the non-provision or improper performance of fly24.bg's obligations as specified in these General Terms and Conditions, they will be resolved through negotiations or according to the claim procedures. Any claim related to the purchased service must be submitted in writing within 7 days from the date of the reported event. The response period for the submitted claim is 30 calendar days.

5.8 All disputes arising in connection with these General Terms and Conditions and the provision of our services will be resolved before the competent courts in Romania.

Processing of personal data means any operation or set of operations performed on your personal data, whether automated or not, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, aligning or combining, restricting, blocking, deleting, destroying, archiving.
